Account Setup

Your account will be established once we have received payment and screened the order(s) for potential fraud in conjunction with our payment partner(s). You are responsible for providing us with an email address that is not associated with the domain(s) you are signing up under. In cases of abuse or when it becomes necessary to contact you, the primary email address on file will be used for this purpose. It is your duty to ensure that the email address on file is kept current and up to date at all times. Supplying false contact information of any kind may result in the termination of your account. In high-risk transactions, government-issued identification and possibly a scan of the credit card used for the purchase may be required. Failure to meet these requirements may lead to the order being considered fraudulent and denied.

Transfers

While our transfers team will make every effort to assist you in moving your site to us, we cannot guarantee the transfer process. This service is provided as a courtesy, and the availability and duration of the transfer may vary due to differences in host configurations. We will do our best, but in some instances, we may be unable to assist with data transfer from your previous host.

Abuse & Prohibited Use

Kingdom Web retains the right to determine what constitutes abuse, and any activity not explicitly mentioned below is at the discretion of Kingdom Web staff.

Abuse includes, but is not limited to, the following offenses:

A) Any attempt or actual compromise of a network device belonging to Kingdom Web or any other entity is strictly prohibited. This includes port scanning, IP range scanners, and vulnerability scanning. Violations will be thoroughly investigated and may lead to immediate service termination.

B) Denial of Service attacks targeting us or any attempt to launch a Denial of Service attack from our servers is strictly prohibited. Infractions will be vigorously investigated and may result in service termination.

C) Sending unsolicited email, newsgroup postings, chain letters, or anything that qualifies as “spam” is strictly prohibited. Gathering email addresses for unsolicited email, a practice known as “harvesting,” is also prohibited and may result in service termination.

D) Hosting material that infringes on any copyright, trademark, or service mark is strictly prohibited. This includes storing and transmitting pirated content like movies, music, software, or other “warez.” Complaints will be investigated and may lead to service termination.

E) Illegal content, such as child pornography, hate speech, scam sites, phishing sites, and other material considered illegal in Canada, is strictly prohibited. Violations will be thoroughly investigated and may result in immediate service termination.

F) Hosting software, source code, or any other material that is illegal or could be used for illegal activities is strictly prohibited. This includes, but is not limited to, software exploits, hacking tutorials, hacking tools, viruses, trojans, bomb-making guides, and similar content. Violations will be thoroughly investigated and may result in immediate service termination.

G) The use of IRC software, Bit Torrent software, Proxy software, and automated “bots” is strictly prohibited. Usage of certain forums and multi-user chat software that could disrupt other users or attract Denial of Service attacks is also prohibited. These issues will be addressed on a case-by-case basis, with the aim of reaching a satisfactory resolution for all parties.

H) Offering image, file, document, or data storage and free hosting or email services is strictly prohibited.

Please note that any violation(s) may result in a warning, temporary suspension of service, or termination of the client’s account(s) without notice and without a refund. In the case of illegal activities, local and/or federal authorities may be notified.

Payment Information

By using Kingdom Web services, you agree to provide payment for services in advance of the service period. Until you notify Kingdom Web of your intention to cancel services, those services will be billed on a recurring basis. It is your responsibility as a client to maintain up-to-date payment information and ensure that all invoices are paid on time. Overdue invoices will incur a 15% late fee and may result in account suspension until the balance is settled. Invoices paid multiple times through PayPal subscriptions can only be credited to the account and are not refundable via PayPal.

Kingdom Web reserves the right to adjust the monthly payment amount and other charges at any time.

Discount & Coupon Codes

Discount and coupon codes are applicable only to the specified Service. These codes are valid for the initial purchase and do not affect the renewal or recurring price of any Service, unless a recurring discount is explicitly stated in the coupon or promotion. Discounts offered after the initial purchase are not applicable. Upon any downgrade, upgrade, or closure of the Service, the discount associated with the code is null and void. Discount and coupon codes have no cash value and cannot be transferred or used for later purchases, downgrades, upgrades, or modifications to any Service. Abuse of discount or coupon codes will not be tolerated and may result in account suspension, account closure, or retroactive adjustment of charges. Kingdom Web reserves the right to discontinue any discount code or promotion at any time, with or without notice, for any reason.

Cancellations

Customers are free to cancel their account at any time by contacting our Billing Team with their account information. Similarly, Kingdom Web reserves the right to cancel any account at any time, for any reason, including but not limited to a breach of this Agreement or the AUP.

Bandwidth & Storage Usage

Your hosting plan includes a monthly bandwidth and storage allowance. If your account surpasses the allocated limit, we may suspend the account until additional bandwidth or storage is purchased at an extra fee, suspend the account until you upgrade to a higher-level package, terminate the account, and/or charge an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Backups & Data Loss

Your use of our service is at your sole risk. Our backup service runs daily, keeping only 30 days of backups. This service is provided as a courtesy, and Kingdom Web is not responsible for files and data residing on your account. Customers are advised to maintain current copies of all hosted content, despite any agreement by Kingdom Web to provide backup services.

Uptime Guarantee

While Kingdom Web strives for a 99.9% network and server uptime service level, we cannot guarantee it. This uptime percentage is calculated monthly and is based on Kingdom Web’s monitoring systems or Kingdom Web authorized/contracted outside monitoring services.

Support Scope

You are responsible for the installation and operation of any scripts or applications. We do not troubleshoot or provide support for malfunctioning scripts or applications. It is your responsibility to maintain the latest versions of scripts and applications.

Right To Refusal Without Cause

Kingdom Web reserves the right to reject any customer or website for participation in the Kingdom Web network at its sole discretion.

Indemnification

Customers agree to defend, indemnify, and hold Kingdom Web harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees, arising from services provided, products sold, or any material supplied by the customer. This includes any injury to persons or property, infringement on the proprietary rights of a third party, copyright infringement, and any defective products sold to customers from Kingdom Web.

Arbitration

By using Kingdom Web services, you agree to binding arbitration. Disputes or claims against Kingdom Web or its subsidiaries will be handled by an arbitrator chosen by Kingdom Web.
